Judge Says Lawsuit Against New-Indy Can Move Forward

A new court ruling will allow one of the lawsuits against the New-Indy Containerboard paper mill in Catawba, S.C., to proceed. Residents living close to the York County paper processing facility sued New-Indy, accusing the company of violating the Resource Conservation and Recovery Act and the Federal Water Pollution Control Act. A judge has ruled that the majority of the claims in the case can go forward. People living near the plant say they have had health problems from the mill's emissions. The EPA said the mill has not violated the most recent consent decree, which limited how much hydrogen sulfate the plant can pump out over a period of time. New-Indy notes that there is no standard set by the federal government for emitting the gas when it comes to paper and pulp plants and no evidence hydrogen sulfate is hazardous.
