AI-enabled prescription glasses can raise concerns about workplace privacy, recordings, and confidential information. In this month’s Q&A, The Workplace Advisors explain whether employers can prohibit these devices and how workplace policies can address their use.
Question: An employee just told me that their new prescription glasses are AI-enabled, allowing them to record audio and video in addition to accessing AI quickly and easily. We are concerned about the implications of these features in the workplace, especially in sensitive areas and around confidential information. Can we prohibit the employee from wearing them at work?
Answer: Because the glasses are prescription, you will probably need to allow the employee to wear them. However, you can remind the employee of your company’s policies covering technology use, AI use, and the protection of confidential information.
If you do not already have one, you should also develop a policy addressing photography and audio and video recordings, including restrictions in areas where employees expect privacy, such as restrooms or locker rooms. The policy should also require employees to notify anyone they are recording. However, because some photography and recordings are protected by law, you cannot issue a blanket ban.
Add any new policies to your handbook and update existing policies to address this emerging technology.
